Professional Bio:

I am a senior associate with Laffey, Sebranek, Auby & Ristau, S.C.  and have been zealously collecting and enforcing Creditors' Rights since 1991 in Wisconsin state courts as well as in bankruptcy court in  Chapter 7, 11, 12, and 13 bankruptcies. 

Collection law is my main area of practice and I provide the following services:

  • Collect on both consumer and business accounts such as bank notes, mortgages, medical services, cattle feed, farm equipment, freight services, personal injury judgments and attorneys’ fees to name just a few.
  • Consumer and commercial litigation for the collection of money, foreclosures, and the repossession of collateral, such as boats, cars, semi trucks, farm equipment, and livestock.
  • Extensive experience in skip tracing, locating employment, bank accounts and assets.
  • Handle everything from the initial lawsuit to picking up the collateral and having it sold.
  • My post judgment collection experience includes the garnishment of paychecks, milk checks, accounts receivable, and bank accounts.
  • Arrange for the seizing and sale of debtors’ property (such as real estate, cars, cash register contents) to pay on the judgment.
  • Representation of creditors in bankruptcies to ensure fair treatment of creditors in proceedings in Chapters 7, 11, 12 and 13 bankruptcies.  File motions for adequate protection, motions for relief from stay, motions to prohibit use of cash collateral, proof of claims, and negotiates stipulations for creditors in bankruptcy cases.
  • Serve as a court ordered receiver to tackle more difficult collection situations.
  • Domestication of foreign judgments in Wisconsin as well as assisting clients to locate out-of-state counsel to domesticate their Wisconsin judgments in other states and facilitate collection in other states.
  • Assist clients in fine tuning their customer applications and account agreements to maximize collection (including attorneys’ fees and collection costs if permitted by law) should the customer’s account go to collection.
